Nanoco Group PLC (LSE:NANO) said its US litigation showdown with Samsung Electronics was rescheduled by the court again.
The intellectual property (IP) litigation trial had been scheduled to start on 12 September but the maker of cadmium-free quantum dot technology said earlier this month that the court was moving this to 3 October.
And the group said today the court has now advised that another case that was scheduled to go to trial on 3 October 2022 will now go forward as scheduled. Nanoco's case will be considered when the court next sets a scheduling order for subsequent trial dates.
"As is the usual practice, the court had scheduled a number of trials for the same dates given that, historically, the majority of cases settle before trial," Nanoco said.
Chief executive Brian Tenner said that these changes are "one minor downside to the system in Texas that delivers trials and outcomes at a much faster rate than most other jurisdictions in the US".
He said the company will update investors when it gets a revised trial date, and when it moves to first in the schedule and can be confident that the trial will start on the day in question.
"Our team of witnesses and advisers will remain in a state of readiness for a trial at any time in the short term," he said.
In August, as the parties and their lawyers met the judge in an August pre-trial conference, the Manchester-based company revealed it had an unaudited cash position of £6.8mln at the end of July, which it said would give it enough to reach 2025, "beyond the expected point at which the group's organic operations become self-financing".
The US Patent Trial and Appeal Board ruled in favour of the UK company in May in all of its patent claims over Samsung's alleged wilful infringement of the IP for Nanoco's cadmium-free quantum dots.
