MetalNRG PLC (LSE:MNRG) said it has moved for summary judgements against two of the three defendants in its High Court case.
It wants the court to strike out defences filed by Brit Energy Holdings LLP and a joint venture company BritNRG Limited. It is also requesting that the series of agreements entered into last April should be set aside. Additionally, it is claiming back £1.02mln paid to the LLP plus interest and costs.
“The application for summary judgement has been made on grounds that no sustainable or credible defence has been pleaded in the case to date by either the LLP or the joint venture company,” investors were told.
“It is, of course, expected that the application will be defended and it will be necessary for the court to rule on it in due course.”
A further defendant in the MetalNRG case, Pierpaolo Rocco, is not subject to the summary judgement application for "technical reasons".
“However, if successful, the application for summary judgement will significantly narrow the issues in dispute with Mr Rocco to be heard at any future trial,” the company said.
