Genetic Technologies (ASX: GTG; NASDAQ: GENE) has reported that as U.S. court denied a motion brought by Agilent Technologies to dismiss the patent infringement law suit brought against it by GTG.
This significant result follows the separate success reported in February, when the U.S. Patent and Trademark Office ruled that all aspects of the GTG patent remained fully valid.
With the removal of what some potential licensees have apparently used as a reason to delay settlement discussions, commercial negotiations can now resume in earnest.
GTG is a molecular diagnostics company commercialising genetic testing, cancer diagnosis and non-coding DNA.
Genetic's US subsidiary Phenogen’s lead product, BREVAGen™, is a first in class, clinically validated risk assessment test for non-familial breast cancer.
