Genetic Technologies Limited (ASX: GTG; NASDAQ:GENE) has received a further ExParte Re-Examination Certificate from the United States Patent and Trademark Office (USPTO).
The Certificate follows a request for re-examination of particular non-coding DNA claims by the Merial company of Georgia, USA, as reported in September 2013.
In the Certificate, the USPTO confirms the patentability of the Genetic claims questioned by Merial.
The successful resolution of this fourth re-examination of one of Genetic's key patents reinforces the strength of the Company’s patent portfolio.
It is significant because some potential licensees have previously expressed concerns over the uncertainty, however Genetic and its possible partners can now move forward with confidence.
