Of course tech behemoth Apple (NASDAQ:AAPL) is never far from the headlines - global player such that it is.

But today, major news surrounding the group had an unusual feel about it and threw up the question of hacking and ethics.

It emerged that a US court had ordered Apple to help the FBI gain access to an iPhone belonging to one of the San Bernardino terrorists.

It was the worst terrorist attack inside the US since 9/11 and saw a couple kill 14 people.

Apple however says it opposes the court order to help FBI investigators access data on the handset belonging to gunman Syed Rizwan Farook.

In a statement, chief executive Tim Cook said: "The United States government has demanded that Apple take an unprecedented step which threatens the security of our customers."

"We oppose this order, which has implications far beyond the legal case at hand." Shares in Apple are up 1.12% at the time of writing at US$97.71.

Elsewhere , biotechs were doing well. Ocular Therapeutix (NASDAQ: OCUL) shot up 40% on Nasdaq after a positive meet with the all powerful FDA and it outlined the Phase 3 clinical development strategy for its OTX-TP (travoprost) candidate for glaucoma and ocular hypertension.

Shares of Synthetic Biologics (NYSEMKT:SYN) also jumped by more than 13% after the company announced that it had been granted a patent which covers its proprietary active agent SYN-010.

What's hot? What's not?

Fossil Group (NASDAQ:FOSL) up over 27% to US$43.85 after posting fourth quarter earnings, which came out after hours, and smashed expectations.

Garmin (NASDAQ:GRMN) up 14% at US$40.21 after the GPS device and wearable fitness product maker beat estimates posting fourth quarter earnings.

Kinder Morgan (NYSE:KMI) up 11% at US$17.34 after news late Tuesday that Warren Buffett's Berkshire Hathaway owns 26.5mln shares as the savvy investor showed faith in the oil industry besieged by crude prices at around 12-year lows.

Devon Energy (NYSE:DVN) down 7% at US$19.79 after second quarter revenue missed by a substantial margin.
