The long-simmering legal clash between Elon Musk and Open AI's Sam Altman is set to move into the courtroom this week, with jury selection beginning in what Wedbush Securities has described as a “tech soap opera.”
The high-stakes, personality-driven trial got underway Monday as jury selection kicked off in Elon Musk's $134 billion lawsuit.
The case centers on allegations that OpenAI deviated from its original charitable mission. Musk’s claims include breach of charitable trust, unjust enrichment, and fraud, arguing that OpenAI’s transition toward a for-profit structure, and its deep partnership with Microsoft, violated foundational commitments made at its inception.
Musk is also seeking the removal of Altman and OpenAI president Greg Brockman from their roles, aiming to unwind parts of the company’s restructuring. OpenAI has denied all allegations, calling them “baseless” and framing the lawsuit as a competitive maneuver from Musk’s own AI venture, xAI, which has increasingly positioned itself as a direct rival in the rapidly intensifying AI race.
Wedbush noted that the trial marks the latest escalation in a broader feud that has already spilled across multiple legal fronts, including prior disputes involving xAI and OpenAI over competition and intellectual property.
At the center of the dispute is a pivotal question: whether OpenAI violated its nonprofit mission when it adopted a hybrid structure and accepted major investment from Microsoft. That issue could carry implications not only for OpenAI’s governance but also for the broader AI sector, where capital intensity and commercialization are increasingly reshaping research organizations.
Wedbush noted that the case has evolved beyond legal arguments into a highly personal confrontation between two of Silicon Valley’s most influential figures. “We believe there will be a lot of dirt and slings thrown around in court between Musk and Altman and that is not a good thing for anyone involved...but Musk has made this personal,” analysts wrote.
For investors, the trial represents not just a legal battle, but a public airing of one of the most consequential rivalries in the AI era.
