EPA announces permitting reform to speed up power generation construction, reshore manufacturing

The US Environmental Protection Agency (EPA) on Tuesday has introduced a new permitting reform aimed at delivering clearer guidance and speeding up the construction of essential power generation and reshored manufacturing projects.

The announcement introduces new flexibility into the New Source Review (NSR) preconstruction permitting process, allowing companies to start certain non‑emissions‑related activities, such as pouring cement construction pads, before securing a Clean Air Act construction permit.

The reform is expected to differentiate emissions‑related components from those that can proceed without an NSR permit, thereby streamlining timelines and reducing uncertainty for developers.

The EPA decision aligns with the Trump administration's ‘Powering the Great American Comeback’ agenda, in which the EPA supports infrastructure investments to boost domestic energy production and manufacturing.

Trump’s EPA also intends to promote the development of data centers critical to making the US the “Artificial Intelligence (AI) capital of the world”.

“For years, Clean Air Act permitting has been an obstacle to innovation and growth,” EPA Administrator Lee Zeldin said in a statement.

“Today’s guidance is another step to allow the build out of essential power generation, data centers, and manufacturing projects that will bring about America’s Golden Age.”
