TikTok Global has urged a federal appeals court to overturn a law that would force Chinese parent ByteDance to sell its US assets or face a ban.
Claiming factual errors were made by the US Department of Justice, TikTok said that its user data and content moderation for US users are managed and stored within the United States, specifically on Oracle-operated cloud servers with no links to China.
The DoJ has alleged that TikTok poses a national security risk by potentially allowing the Chinese government to access the data of US users.
Under the new law introduced by President Biden, ByteDance must divest TikTok's US operations by January 19 or face a ban.
TikTok's legal challenge will be heard on September 16, placing the app's fate in the final weeks before the November 5 presidential election.
"By the government's logic, a US newspaper that republishes the content of a foreign publication - Reuters, for example - would lack constitutional protection," TikTok stated.
The law also prohibits app stores from offering TikTok and internet hosting services from supporting the app while it is still owned by ByteDance.
