Immunic Inc (NASDAQ:IMUX) has received a Notice of Allowance for a composition-of-matter patent covering a specific polymorph of vidofludimus calcium, which is being advanced as a treatment for chronic inflammatory and autoimmune diseases, particularly multiple sclerosis.
The patent, titled "Calcium salt polymorphs as anti-inflammatory, immunomodulatory and anti-proliferative agents," solidifies the company's intellectual property protection around its lead, late-stage asset.
It is the fourth US patent directed towards the use of vidofludimus calcium in treating multiple sclerosis.
The approval of the patent adds a crucial layer of intellectual property protection to Immunic's primary late-stage asset, according to Daniel Vitt, Immunic’s CEO, and will also encompass the method of production for the material used in their studies.
“Our commitment to protecting the technology behind this Phase 3 asset remains paramount and is made that much stronger by the addition of this fourth US patent directed to the use of vidofludimus calcium in multiple sclerosis,” Vitt said in a statement.
Immunic also has eight patent families active for vidofludimus, Vitt noted.
The patent, which was previously granted in Australia, Canada, Indonesia, Japan, and Mexico, is expected to provide protection into 2039, unless extended further.
Vidofludimus calcium, the subject of the patent, is covered by several layers of granted patents in the United States, Europe, and other jurisdictions globally. These patents encompass various aspects, including composition-of-matter for salt forms of vidofludimus, treatment of relapsing multiple sclerosis with specific dose strengths, dosing regimens used in clinical trials, as well as a specific polymorph of vidofludimus calcium and its method of production.
In the United States, these patents extend protection into 2041, with a pending application potentially extending it to 2044. Immunic also disclosed ongoing undisclosed patent applications aimed at further bolstering its exclusivity period. Additionally, vidofludimus calcium, as a new chemical entity, is poised to benefit from regulatory data protection.
