African mining and its role in the global energy transition

A report by Allen and Overy titled Mining in Africa and its role in the global energy transition, delves into the significance of Africa's mining sector in the global energy shift. The document highlights the pivotal position of the continent and its mining companies in confronting climate change, noting the forecast by the World Economic Forum that three billion tonnes of critical minerals are needed to achieve Net Zero by 2050.

Allen and Overy's analysis identifies the main factors for successful and sustainable mining of critical minerals in Africa. These include addressing the global financing gap for Net Zero, ensuring a just and equitable energy transition, setting and achieving ambitious decarbonisation targets, managing resource nationalism, understanding the long-term demand for critical minerals, and considering the impact of artificial intelligence and new technologies.

Notably, the firm emphasises the environmental, social and governance (ESG) imperative and the associated risks of disputes and litigation.

Insights, opportunities and challenges

The legal practice firm offers insights into the opportunities and challenges facing resource companies, investors, and stakeholders in Africa, underscoring the advantages of sustainable development frameworks for African nations and their peoples.

“To ensure a just and fair energy transition, Africa must develop clean energy infrastructure and utilise its critical minerals to improve living standards, abate power shortages and reduce emissions," Matthew Townsend, co-head of Allen and Overy’s International Environmental, Climate and Regulatory Law Group said.

He added, “For companies operating in Africa, the challenge is to refocus their strategies on critical minerals and address operational aspects of sustainability such as supply chain transparency, and good risk governance and reporting. Businesses should not underestimate the scope and importance of this task.”

Matthew Johnson, co-lead of the firm’s global mining practice, remarked, “The African continent holds much of the promise of the world’s transition to a clean energy future."

Johnson pointed out that “critical mineral supply is already a key focus of business agendas and will continue to be for decades to come. It has already affected the profile of assets being sought for acquisition and targeted for development, together with capital allocation going forward.”

Johnson also noted, “Australia’s resources sector is in a unique position to back strong African projects that will deliver on this global promise. The Western Australian mining industry in particular has good access to capital and, importantly, the talent pool required to bring projects online, operate mines and navigate jurisdictional differences.”

Finally, Gerhard Rudolph, co-lead of Allen and Overy’s global mining practice, highlighted the necessity of a proactive approach to jurisdictional differences in Africa, stating, “A pro-active approach to, and keen awareness of, jurisdictional differences across Africa is crucial for mining companies to minimise the risk of legal challenge on ESG grounds."

He concluded by emphasising the sector’s imperative to adapt, “The major implications for mining companies operating in Africa have created an imperative to pivot practices and principles that will ensure the sector’s viability and sustainability into 2050 and beyond.”
