Elon Musk’s X sued over trademark breach by ad agency of same name

Ad agency X Social Media accused Musk's X of using the name despite being aware of the former's rights to it

Elon Musk’s renamed Twitter Inc (NYSE:TWTR) platform, X Corp, has been hit with accusations of trademark infringement by ad agency X Social Media.

According to the latter, Musk’s use of the ‘X’ name has led to confusion among the ad agency’s customers over its association with the rebranded version of Twitter.

X Social Media filed a case in Florida federal court on Monday as a result, seeking an order for Musk’s platform to stop using the name, alongside damages.

“In a short time, X Corp has wielded its social media clout, marketing resources, and overall national notoriety to dominate consumer perception of its ‘X’ mark,” the ad firm’s complaint said.

Florida-based X Social Media added that its revenue had already taken a hit since Musk’s rebrand.

Musk’s company’s due diligence checks would have made it “well aware” of the existing rights relating to the ‘X’ name, the ad agency claimed.

Following on from accusations of wrongful termination, copyright infringement and employment discrimination, the case marks yet another legal spat for Musk in the year since he acquired Twitter for US$44 billion.
