enCore Energy Corp announced that the United States Court of Appeals for the District of Columbia Circuit has denied the request of the Oglala Sioux Tribe and the group ‘Aligning for Responsible Mining’ for a full panel review of a prior decision by a three-judge panel of that court.
The uranium development company said in the previous decision, the panel found that the Nuclear Regulatory Commission had adequately complied with the relevant statutory and regulatory requirements in granting a source materials license to enCore subsidiary Powertech USA Inc, for extraction of uranium from ore beds at the company's Dewey-Burdock project in South Dakota.
enCore noted the Sioux tribe and ‘Aligning for Responsible Mining’ group may petition the United States Supreme Court to review the ruling.

enCore’s 100% owned Dewey Burdock project is an in-situ recovery (ISR) uranium project, which is forecast to produce 14.3 million pounds of uranium oxide over its 16 years of production, with positive cash flows projected in the second year of production, according to the company.
enCore Energy is the most diversified ISR uranium development company in the US and recently announced it entered into a definitive agreement to acquire the Alta Mesa ISR uranium project.
The company is focused on becoming the next uranium producer from its licensed and past-producing South Texas Rosita Processing Plant by 2023.
