Retortillo itself has just held municipal elections in which four out of the five council seats contested were won by candidates supportive of the Berkeley Energia’s plans to develop Salamanca.Villagers from Retortillo and the surrounding community have consistently campaigned "Si a la Mina".

The company continues to await the recommendation report from the Nuclear Safety Council and has appealed, along with others, the recent appointments to the Board of the Council and awaits the Supreme Court's ruling on this matter.

Previous geochemical analysis on the new exploration ground has shown the licence areas to be prospective for the battery and EV metals lithium, cobalt, tin, tungsten and rare earth elements. The company is accelerating plans to further define, and test drill these targets.

"We are pleased for the villagers who have been campaigning hard for the investment to now be so well represented on the municipal council,” said Berkeley chief executive Paul Atherley. “We look forward to working with the new council in achieving the outcome that the community wants.”

In morning trading, shares in Berkeley Energia were 1% higher at 3,603p.

The uranium miner said that during the first three months of the year it had received “a number of favourable assessments” from various regulatory bodies for its Salamanca project in Spain, including two from the Spanish government’s Nuclear Safety Council (NSC).

Berkeley said it was now awaiting a recommendation report from the NSC, although it added that it would notify shareholders of a decision by the country’s Supreme Court regarding various legal challenges against new appointments to the body after media reports came to light in early April.

Meanwhile, the firm said it would continue to focus on starting construction of the Salamanca mine, with engineering designs for the site currently under review.

The group also retained a cash balance of around £52.8mln (A$97mln) in the quarter.

Strong fundamentals in uranium market

Regarding the uranium market, Berkeley said fundamentals “continued to remain strong” with constrained supply and a growing demand outlook.

The company currently has 2.75mln pounds of triuranium octoxide, a compound of uranium, under contract for six months with another 1.25mln pounds of optional volume, with an average price of over US$42 per pound.

In mid-morning trading on Wednesday, Berkeley’s shares were up 1.3% at 19.5p.

In the meantime, the group added, it continues to progress the approvals for the Salamanca mine and will advise shareholders as soon as any decision is made by the Nuclear Safety Council.

Reuters reported last week that Berkeley Energia had appealed to Spain’s Supreme Court against the nomination of new members to the country’s nuclear safety council, which is due to assess the group’s uranium mine project near Salamanca.

The newswire said that in a document released on Thursday, the court had rejected a request from Berkeley to urgently suspend a government decree last week which named four new members to the Nuclear Safety Council’s five-strong board, which rules on the safety of nuclear and radioactive facilities.

The proposed new members include an ecological activist, who has campaigned against Berkeley’s mine project, Reuters added.

The court gave the Spanish government 10 days to offer its side of the story before deciding how to proceed, it said.

Following recent Spanish ministerial approval, the company has now received all the European Union and national level approvals required for the initial development of the Salamanca project and is awaiting local licences.

The large scale uranium area has the potential to support a long life mining operation, with near surface, high-grade deposits for very low operating costs.

The group has said the project will generate measurable social and environmental benefits in the from jobs and skills training in a depressed rural community.

It believes the project will also make a significant contribution to the security of supply of Europe’s zero-carbon energy needs.

How’s it doing:

On 11 March 2019, Berkeley Energia said it has received a number of favourable assessments from various regulatory bodies in regard to permitting at its Salamanca uranium mine, including two assessments from the Nuclear Safety Council.

Berkeley is now awaiting the recommendation report from the Nuclear Safety Council to the relevant minister.

As previously announced, Berkeley also confirmed that it has been informed that the local municipality remains unable to award the Urbanism Licence due to a number of outstanding items which currently being addressed by the company.

In October 2018, Berkeley had said that the timing of the award of the Urbanism Licence was “uncertain” and it, therefore, had commenced a cost-reduction programme.

The company has said it has strong support from key stakeholders after more than 200 of Salamanca's business community came together in support for the €250mln investment involved in the area.

The firm has received the backing of the local community, with a recent petition supporting its project signed by nearly 1,500 residents in towns surrounding the site.

The company has also recorded over 22,500 job applications for the project, with 400 of those coming from nearby villages and of those, over 110 from the local village of Villavieja, representing 25% of its population.

It probably helps that Berkeley Energia is now also listed in Spain, the only mining company on the bourse there, as well as on the main board of the London Stock Exchange.

The group remains in a relatively strong financial position with A$100mln in cash on the balance sheet as at the end of the six months to 31 December 2018.

In a January 2019 update, Berkeley had highlighted that the fundamentals for uranium mining remain “very strong”.

In the quarterly report, Berkeley noted that spot uranium price continued to strengthen during the quarter, rising 4% to US$28.5 per pound by the end of the three months.

It said: “The fundamentals for uranium remain very strong with continued supply disruption being met by a re-contracting cycle for US and EU utilities; and continued increases in global nuclear capacity.”

The group has around 2.75mln pounds of uranium (U3O8) under contract for the first six years of operation, with another 1.25mln pounds of optional volume, at an average price of US$42 per pound.

Berkeley also revealed in January that soil sampling close to the Salamanca mine site has identified other elements as well as uranium including gold, lithium, cobalt, tin and rare earths.

It said it has applied for twelve new investigation permits, covering 350 square kilometres.

In the statement, Berkeley detailed progress with permitting for the mine. It said it has received a number of favourable assessments from various regulatory bodies regarding radiological and environmental surveillance plans for certain aspects of the project relating to water.

The company said it awaits the recommendation report from the Nuclear Safety Council to the relevant minister.

Additionally, noted that it has been informed that the local municipality remains unable to grant the Express Resolution on the award of the Urbanism Licence due to a number of outstanding items – it clarified that these issues have been disclosed previously and are being addressed by the company.

Environment remains a priority

“The Salamanca mine is being developed to the highest international standards and the company's commitment to the environment remains a priority,” Berkeley said.

“It holds certificates in Sustainable Mining and Environmental Excellence which were awarded by AENOR, an independent Spanish government agency. The company has been re-awarded both certificates following a consultation process with the agency.”

Berkely also told investors that it continues to advance review of engineering designs for the project.

Exploration activities, meanwhile, continue. The company said that soil sampling close to the Salamanca mine site has identified other elements as well as uranium including gold, lithium, cobalt, tin and rare earths.

In a note to clients, analysts at Shore Capital noted: "In October 2018, Berkeley said that the timing of the award of the Urbanism Licence was “uncertain” but “unlikely to be received imminently”. The company, therefore, commenced a cost-reduction programme, but remains in a relatively strong financial position with A$100m of cash as of end CY2018." 

In late morning trading, shares in Berkeley Energia were 18.5% higher at 27.25p.

It isn’t the first time the company has had to battle media speculation around potential approval for the Salamanca project after a Reuters report in October suggested the mine would not receive approval from the Spanish government despite already being given preliminary approval.

The firm was then forced to refute media speculation once again that month when more press reports emerged that the government was intending to deny permits for the mine, with Spain’s Nuclear Safety Council saying it was not the source.

In a note to clients, analysts at broker Shore Capital said that the Spanish press had "apparently" reported that approval for the project had been granted, adding that a Reuters report yesterday had said "Spain’s nuclear watchdog CSN had “endorsed” two nuclear safety studies, in “a preliminary step in the approval process”".

Shares were up 17.3% at 24.7p

A Reuters report suggested Spain’s government would not issue the required permits for construction to go-ahead, even though the project was granted preliminary approval.

The article highlighted also that opponents of the Salamanca project will have a majority on Spain's Nuclear Safety Council when it renews its board shortly.

In a statement, Berkeley said that it had received no official notice from the Nuclear Council nor any other government department to that effect.

The company added it had contacted both the Council and Energy and Environment Ministry to clarify the position.

Two permits are needed for the work to start - a local building licence and permission to handle radioactive waste.

Berkeley shares were suspended in Australia following the article but remained trading on AIM where they fell 45% to 14.4p, valuing the group at £43mln.
